General conditions of sale
Between Sam Shop Company, located in Compiègne, represented by Sam Shop as manager, duly authorized for the purposes herein.
Hereinafter the ‘Seller’ or the ‘Company’.
On the one hand, and the natural or legal person making the purchase of products or services of the company, Hereinafter, “the Buyer”, or “the Customer” On the other hand, It has been explained and agreed as follows:
The Seller is a seller of clothing and accessories exclusively for consumers, marketed through its websites Samshop.fr. The list and description of the goods and services offered by the company can be consulted on the aforementioned sites.
Commands:
1- Once your order has been validated, you will receive a confirmation email.
2- A second email will be sent to you within a period between 1 and 10 days concerning the preparation of your package in which the tracking number is included. If you don’t see the email, check your spam because it’s automatic.
If after checking all this within 15 days you see nothing, you can send me an email in which you should indicate your order number or your first and last name and I will send you your tracking number
Any incomplete email will not be processed
Article 1: Subject matter and general provisions
These General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of Products offered by the Seller.
These General Terms and Conditions of Sale (GTC) apply to all sales of Products, made through the Company’s websites that are an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these terms and conditions at any time by publishing a new version on its website. The GTC applicable then are those in force on the date of payment (or of the first payment in case of multiple payments) of the order. The Company also ensures that their acceptance is clear and unqualified by setting up a checkbox and a validation click. Article 2: Prices
The prices of the products sold through the websites are indicated in Euros excluding taxes and precisely determined on the pages of descriptions of the Products. They are also indicated in euros all taxes included (VAT + any other taxes) on the order page of the products, and excluding specific shipping costs. For all products shipped outside the European Union and/or DOMTOM, the price is calculated automatically before tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums do not fall within the Seller’s jurisdiction. 8. Applicable law and jurisdiction.
Any dispute relating to the use of the Samshop.fr website is subject to French law. Except in cases where the law does not allow it, exclusive jurisdiction is assigned to the competent courts of the city➢ Delivery of products. The Customer will then receive confirmation by e-mail of the payment of the order, as well as an acknowledgement of receipt of the order confirming it.
For products delivered, this delivery will be made to the address indicated by the Customer. For the purposes of ordering, and in accordance with Article 1316-1 of the Civil Code, the Customer undertakes to provide his/her truthful identifiers.

Article 4: Products and services

The Seller undertakes to honor the order of the Customer within the limits of the stocks of Products available only. Otherwise, the Seller informs the Customer. Article 5: Retention of title clause
The products remain the property of the Company until full payment of the price.
Article 6: Terms of delivery
The products are delivered to the delivery address that was indicated at the time of the order and the time indicated. This delay does not take into account the lead time for preparing the order.
The Seller provides a contact form to follow up on customer service. The Seller recalls that when the Customer takes physical possession of the products, the risks of loss or damage of the products are transferred to him. It is up to the Customer to notify the carrier of any reservations on the product delivered.
Article 6-2: Delivery times
In Relay Point: The customer has the choice between selecting the relay point they want or letting us select the relay point closest to their address. Orders are usually placed at relay points once a week.
Shipping costs: Shipping costs are borne by the customer in full. These fees vary according to the weight and destination of the package.
The processing time for your parcels is 1 to 2 working days in addition to the following shipping times:
Delivery time Colissimo: 48 to 72 hours working days
World Relay France, Europe and Home Europe Delivery Time : 4 to 5 working days
Delivery time is estimated from 3 to 6 working days depending on the destination. This delay is a simple estimate, it can vary significantly depending on the demand and the quantity of packages to be prepared. The order remains on time as long as the shipment does not exceed 15 working days between the date of confirmation of the order and the notification of the shipment of the goods. If you choose the option in person once your order is ready, you will receive a confirmation email with the place and time of appointment.
Article 7: Availability and presentation
Orders will be processed within the limits of our available stocks or subject to the stocks available from our suppliers. If an item is unavailable for more than 100 business days, you will be immediately notified of the expected delivery times and the order for that item may be canceled on request. The Customer will then be able to request a credit for the amount of the item or its refund.
Article 8: Payment
Payment is due immediately upon order, including for preorder products. The Customer can make the payment by credit card or through the Paypal solution. Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa).Secure online payment by credit card is made by our payment provider. The information transmitted is encrypted in accordance with the rules of the art and cannot be read during transport on the network. Once the payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. The commitment to pay given by card is irrevocable. By providing its banking information at the time of sale, the Customer authorizes the Seller to charge its card the amount relating to the indicated price. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error or inability to charge the card, the Sale is immediately terminated
Article 9: Exchange or refund
All returns are subject to the general conditions of sale and the conditions of returns and exchanges accepted beforehand during the order
All returns must be made only by Mondial Relay, the return costs are the responsibility of the customer, the return time upon receipt of the package is 15 days. Beyond this period, we cannot proceed with the return of the package.
Upon return, the package must contain the original purchase invoice or a copy. Please indicate your request on the invoice.
For any request for returns of items, Sam Shop will only make a refund or credit.

All items washed, worn or damaged will be refused, the items on sale are not taken back or exchanged.

The refund period varies between 5 and 10 working days and will be made on the same payment method used by the customer.
Article 10: Guarantees
In accordance with the law, the Seller assumes two guarantees: of conformity and relating to hidden defects of the products. The Seller reimburses the buyer or exchanges the products that appear to be defective or do not correspond to the order placed. We do not accept any liability for defects or damage resulting from storage, handling, transport or use in abnormal conditions or not in accordance with the nature, requirements or suitability for use of the product. The customer will have to go directly to the carrier.

No response will be made if the customer does not comply with this rule
Article 12: Intellectual property rights
Trademarks, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No assignment of intellectual property rights is made through these GCS. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
Article 13 : Force majeure
The performance of the seller’s obligations at the end of this Agreement shall be suspended in the event of an unforeseeable event or force majeure which would prevent its performance. The seller will notify the customer of the occurrence of such an event as soon as possible.
Article 14: Invalidity and amendment of the contract
If any of the terms of this contract were to be canceled, such nullity would not result in the nullity of the other terms that will remain in force between the parties. Any contractual amendment shall be valid only after written and signed agreement of the parties.
Article 15: Protection of personal data
You have the right to query, access, modify, oppose and rectify your personal data. By adhering to these terms and conditions of sale, you consent to our collection and use of this data for the fulfillment of this contract. By entering your email address on one of our network sites, you will receive emails containing information and promotional offers about products published by the Company and its partners. You can register at any time. To do this, simply click on the link at the end of our emails or contact the controller (the Company) by letter RAR. We track traffic on all of our sites. We use tools such as Google Analytic and other statistical tools to do this.
Article 16: Applicable law
All the clauses contained in these general conditions of sale, as well as all the purchase and sale operations referred to therein, will be subject to English law
